Article 1: Services

Created by AZ assists clients with:
• Designing and developing websites.
• Designing and printing flyers, posters, brochures, and other printed materials.
• Creating and editing videos and other media.                                                                                         • Creating social media content.

All agreements regarding deadlines are always recorded in writing in advance.

Article 2: Prices and Payment

1. Prices are agreed upon per assignment or are listed in packages on createdbyaz.nl/prices or in the quote.

2. Payment must be made within 14 working days of the invoice date.

3. If payment is delayed, Created by AZ may temporarily halt the work.

Article 3: Warranty

1. Created by AZ delivers websites, printed materials, and media that work as agreed upon.

2. The client always has the right to legal warranty. This cannot be limited.

3. Additional agreements regarding warranty or maintenance will only be recorded in writing.

Article 4: Liability

1. Created by AZ may be liable for direct damage (such as repair or replacement costs).

2. For indirect damage (such as loss of profit or consequential damage), Created by AZ is only liable in cases of intent or gross negligence.

3. Created by AZ is not responsible for:
   • Modifications made by the client or third parties.
   • Problems caused by hacks, viruses, or failures by third parties.
   • Outdated software or third-party links.

4. Work outside of warranty can be carried out at an agreed rate or through a maintenance contract.

Article 5: Ownership

1. All designs, videos, printed materials, and digital files remain the property of Created by AZ until full payment has been made.

2. In the event of non-payment or bankruptcy, Created by AZ may stop the use of the work or reclaim it.

Article 6: Delivery

1. Created by AZ delivers digital files and printed materials within the agreed time.

2. If there is a delay, the client will be informed in a timely manner.

3. Digital files will be delivered in common formats (such as PDF, MP4, JPEG, PNG, SVG, ID/AI).

Article 7: Cancellation

1. Cancellations must always be made in writing.

2. Cancellations can be made free of charge up to 14 days before the work starts.

3. After the work has started, the full price must be paid.

4. Projects that are not fully paid for may not be used. If used, the full amount will still be invoiced.

Article 8: Force Majeure

1. Created by AZ is not liable if agreements cannot be fulfilled due to circumstances beyond its control.

2. Examples of force majeure include: war, natural disasters, fire, floods, pandemics, government measures, strikes, or disruptions in energy and communication.

3. In case of force majeure, the work will be suspended. If this lasts longer than 60 days, either party may terminate the agreement in writing without costs.

Article 9: Intellectual Property

1. All designs, videos, and printed materials remain the property of Created by AZ, unless otherwise agreed in writing.

2. The client only receives the right to use the work for the agreed-upon purpose.

3. Created by AZ may use the work for portfolio and promotional purposes.

Article 10: Privacy

1. Client data will only be used for administration and communication purposes and will never be shared with third parties.

Article 11: Disputes

1. These general terms and conditions and all agreements between Created by AZ and the client are governed by Dutch law.

2. Disputes arising from or related to the agreement will, in the first instance, be resolved through mutual discussion.

3. If mutual discussion fails, disputes will be submitted to the competent court in the Rotterdam district.

Final Provisions

1. Created by AZ may amend these terms and conditions. The latest version is always available on the website.

2. By using the services of Created by AZ, the client agrees to these terms and conditions.
